1. The Promoter

1.1 The promoter is V.J. Salomone Consumer Lines Ltd (company registration number C26986), 79 Simpson Street, Marsa MRS 1606, Malta (“the Promoter”, “we”, “us”).

1.2 These Terms apply to the ActiPH × HYROX UK “WIN” promotion (“the Promotion”).

2. These Terms

2.1 By entering the Promotion you confirm that you have read, understood and accept these Terms and Conditions (“these Terms”). The entry instructions form part of these Terms.

2.2 If anything in advertising, stickers, packaging, social media or any other promotional material conflicts with these Terms, these Terms apply.

2.3 These Terms are available on the Promotion website for the whole Promotion Period. Please keep a copy for your records.

3. Promotion Period

3.1 The Promotion opens at 00:00 on 1 December 2026 and closes at 23:59 on 31 January 2027, Malta time (“the Closing Date”). Together these are the “Promotion Period”. Entries made outside the Promotion Period will not be accepted.

3.2 Bottles bearing a WIN sticker may still be on sale after the Closing Date, and codes entered after the Closing Date are not valid. We will make reasonable efforts to remove Promotion materials from gyms and other outlets after the Closing Date, but please check that the Promotion is still running before you buy.

4. Who can enter

4.1 The Promotion is open to residents of Malta and Gozo aged 18 or over. Anyone under 18 may enter only with the permission of a parent or legal guardian. We may ask the parent or guardian to confirm their permission and to accept a prize on the entrant’s behalf.

4.2 The Promotion is not open to employees of the Promoter or its group companies, anyone professionally involved in running the Promotion, or the immediate families or household members (including cohabiting partners) of any of them.

4.3 We may ask any entrant or winner for proof of identity, age, residence and eligibility. If it is not provided when requested, the entry or prize may be refused.

5. How to enter

5.1 Purchase is necessary. Buy a bottle of ActiPH Alkaline Ionised Water 600ml that carries an orange “WIN” sticker (a “Participating Product”). It is your responsibility to check that the bottle has a WIN sticker before you buy it.

5.2 Go to actiph.vjscl.com.mt, select “Enter Code”, and enter the unique code printed on the sticker (the “Code”), your full name, email address, mobile number and the sport or activity you practise, and say whether you are 18 or over. If you are under 18, you must confirm that a parent or legal guardian has given you permission to enter (clause 4.1). You must also confirm that you accept these Terms. Choosing to receive news and offers from the Promoter is optional and does not affect your entry.

5.3 Keep the bottle with its WIN sticker and the original purchase receipt. You will need all of them to claim a prize (see clause 9).

5.4 Entries can only be made through the Promotion website. Entries by post, email, social media, telephone or any other means will not be accepted.

6. Codes and valid entries

6.1 Each Code can be entered once only. A Code that has already been entered will be rejected.

6.2 You may enter once for every valid Code you have, and each valid entry counts as a separate entry in the draw. However, each person can win only one prize.

6.3 Codes must be entered exactly as printed. Codes that are illegible, damaged, altered, copied, forged or not issued by the Promoter are invalid. Lost or damaged stickers will not be replaced.

6.4 Entries made in bulk, through third parties, using automated means (such as scripts or bots), or by repeatedly guessing Codes are invalid.

6.5 You must give accurate and complete details. Entries with false, incomplete or someone else’s details are invalid.

6.6 Our records of entries are final. We are not responsible for entries that are not received or not recorded because of technical faults, network or connection problems, or problems with your device.

7. Prizes

7.1 There are six prizes, for six different winners:

• (a) 1 × Apple AirPods 5;
• (b) 2 × one ticket each to a HYROX UK event: HYROX Glasgow (10–14 March 2027) or HYROX Cardiff (20–29 May 2027) (see clause 10.1);
• (c) 3 × 3 months’ worth of ActiPH Alkaline Ionised Water 600ml, one for each winner (see clause 10.3).

7.2 Prizes are as described. There is no cash alternative, prizes cannot be exchanged or transferred, and the Promotion cannot be used together with any other ActiPH promotion.

7.3 If a prize becomes unavailable for reasons outside our reasonable control, we may replace it with a prize of equal or greater value.

8. Selecting the winners

8.1 Within 10 working days after the Closing Date, six winners and six reserve winners will be selected at random from all valid entries received during the Promotion Period, using a computer-generated random draw supervised by an independent person.

8.2 Prizes are allocated in the order winners are drawn: the first winner drawn receives the Apple AirPods, the second and third the HYROX UK tickets, and the fourth, fifth and sixth the 3 months’ worth of ActiPH.

8.3 Because each person can win only one prize, if an entry from a person who has already been drawn is selected again, it will be set aside and another entry drawn.

9. Winner notification and prize claims

9.1 We will contact winners by phone and/or email, using the details given when entering, within 5 working days of the draw.

9.2 A winner must reply within 14 days of our first attempt to contact them. If a winner does not reply in time, is not eligible, or cannot provide the items in clause 9.3, they lose the prize and it will be offered to the next reserve winner.

9.3 To claim a prize, the winner must present, at the Promoter’s offices at 79 Simpson Street, Marsa, or another place we agree:

• (a) the Participating Product bearing the WIN sticker with the winning Code;
• (b) the original purchase receipt for that product; and
• (c) photo identification and, for winners under 18, the consent of a parent or legal guardian.

The Code on the sticker must match the winning entry.

9.4 Prizes must be collected within 30 days of the claim being confirmed. Prizes not collected within that time will be forfeited.

10. Prize conditions

10.1 HYROX UK tickets. Each ticket is valid only for the event and date chosen, subject to availability when the winner chooses. Tickets are subject to the event organiser’s own terms and conditions, including any age, health and fitness requirements. The winner must provide any details the organiser needs to issue the ticket in their name within the time we ask. Travel, accommodation, insurance, meals and all other costs are not included and are the winner’s responsibility. Tickets may not be resold. If the organiser cancels, postpones or changes the event, we will pass on whatever remedy the organiser offers, but we are not otherwise responsible.

10.2 Apple AirPods. Supplied new, with the manufacturer’s warranty only. Apple Inc. is not a sponsor of, and is not involved in, this Promotion.

10.3 3 months’ worth of ActiPH. The bottles are collected from the Promoter in instalments over three months, starting within 30 days of the claim being confirmed.

11. Disqualification

11.1 We may reject any entry, disqualify any entrant and withhold or reclaim any prize if we reasonably believe that the entrant has broken these Terms, acted fraudulently or dishonestly, tampered with stickers, bottles or the entry system, or tried to gain an unfair advantage.

12. Publicity

12.1 We may announce each winner’s first name and town or village on the ActiPH social media channels and the Promotion website. A winner who does not want this can tell us when we contact them.

12.2 Winners may be invited to take part in photos, videos or other publicity, but they do not have to. We will only use a winner’s photos or videos with their separate agreement, which they can withdraw for future use at any time.

13. Liability

13.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the laws of Malta. Nothing in these Terms affects your statutory rights as a consumer.

13.2 Subject to clause 13.1, we are not liable for any loss, damage or injury arising from taking part in the Promotion, or from accepting or using a prize (including taking part in a HYROX event), except where it is caused by our negligence or our breach of these Terms.

14. Changes and cancellation

14.1 If circumstances outside our reasonable control make it necessary, such as fraud, technical failure, or the cancellation of a prize event, we may change, suspend or cancel the Promotion. We will publish any change on the Promotion website, and we will act fairly towards entrants who have already entered.

14.2 If any part of these Terms is found to be invalid or unenforceable, the rest of these Terms will continue to apply.

15. Queries

15.1 For any question or complaint about the Promotion, message ActiPH Malta on Facebook or Instagram, or call +356 2298 3284 (Monday to Friday, 08:00–14:00).

16. Governing law

16.1 These Terms are governed by the laws of Malta, and the courts of Malta have jurisdiction over any dispute about them. This does not take away any rights you have under the consumer protection laws that apply to you.

17. Privacy Notice

17.1 Who we are. The Promoter (clause 1.1) is the controller of the personal data you give us when entering. You can contact us about your data at dpo@vjsalomone.com.

17.2 What we collect. The Code, your full name, email address, mobile number, the sport or activity you practise, whether you are 18 or over, and whether you agreed to receive news and offers from us. When you enter, our system also records the time of each attempt and a scrambled version of your IP address (we do not store the address itself), to prevent misuse. From winners we also check identification, the receipt and the sticker.

17.3 How we use it, and why we are allowed to.

• (a) To run the Promotion: checking Codes, recording entries, making the draw, contacting winners and providing prizes. This is necessary to carry out the agreement you make with us by entering.
• (b) To prevent fraud and misuse of the Promotion. This is in our legitimate interests in running a fair promotion.
• (c) To understand which sports and activities our customers practise, using your answer in combined statistics. This is in our legitimate interests in understanding our customers.
• (d) To keep the records the law requires, for example for accounting.
• (e) To send you news and offers from V.J. Salomone Consumer Lines Ltd by email and SMS, tailored to the sport or activity you practise, but only if you are 18 or over and tick the box on the entry form to agree. This is based on your consent, which you can withdraw at any time using the unsubscribe link in our emails, by replying STOP to our messages, or by contacting us.

Agreeing to receive news and offers is optional and does not affect your entry or your chance of winning.

17.4 Who we share it with. The companies that host and operate the Promotion website and entry system for us, including Vercel, which hosts the website and runs the security check on the entry form, under contracts that require them to protect your data and use it only on our instructions. For HYROX ticket winners, the event organiser, to issue the ticket in the winner’s name. Where this involves sending data outside the European Union, we will make sure it stays protected as data protection law requires. We do not sell your personal data.

17.5 How long we keep it. If you agreed to receive news and offers, we keep your name, contact details and sport or activity for that purpose until you unsubscribe or ask us to delete them. Otherwise, we keep your details only for as long as we need them for the Promotion, including dealing with any questions or complaints about it, and then delete them. Winners’ details are kept for as long as we need them to provide the prize and to meet legal and accounting requirements. Records of entry attempts used to prevent misuse are deleted after 30 days.

17.6 Your rights. You can ask us for a copy of your data, or to correct it, delete it, restrict its use, or transfer it to you. You can also object to our use of it under clauses 17.3(b) and (c). If you ask us to delete your data before the draw, your entry will be withdrawn. You have the right to complain to the Information and Data Protection Commissioner in Malta (idpc.org.mt).
